Terms of Service

These terms cover your use of stayhypd.com, the free automation audit, and any other material we publish here. Read them before you send us a request. If you hire Hypd for a project, a separate written agreement governs that work.

Section 1

Accepting these terms

By browsing stayhypd.com, submitting a form, or requesting an audit, you agree to these terms. If you do not agree, please do not use the site.

If you are acting for a company, you confirm you are authorised to accept these terms on its behalf, and "you" means both you and that company.

Section 2

Who we are

Hypd is an AI automation agency that has built websites, SEO programs, CRM systems, and content operations for owner-led businesses since 2015. We now build AI agents and workflow automations on top of those systems.

Section 3

What this website is

This site is informational. It describes what we do, shows how we approach automation work, and gives you a way to start a conversation. Reading it does not create a client relationship, and nothing here is a binding offer to perform work at a stated price.

We publish no pricing on this site. Scope, fees, timelines, ownership of deliverables, and support terms are agreed in a written proposal or statement of work before a project starts.

Section 4

Who may use the site

You must be at least 18 years old and able to enter a binding contract. The site is aimed at businesses, not consumers, and is intended for use in the United States. If you use it elsewhere, you are responsible for complying with your own local law.

Section 5

The free automation audit

We offer a free audit that maps the repeated work in your business and ranks it by time cost, revenue impact, risk, and how quickly your team could adopt a fix. You keep the resulting workflow map whether or not you hire us to build anything.

What the audit is not:

  • It is not a guarantee that automation will suit your business. If the first workflow is not worth the effort, we will say so.
  • It is not a fixed-price quote. Any build work is quoted separately.
  • It is not a security assessment, a legal compliance review, or an accessibility audit of your systems.
  • It is not a commitment to a delivery date until a written agreement is in place.

We may decline or stop an audit at our discretion, including where a request looks automated, where we cannot verify authority over the site in question, or where the work falls outside what we do.

Section 6

What you send us

When you submit a form, request an audit, or share access to a system, you confirm that:

  • The information you give us is accurate, and the contact details are yours.
  • You own or are authorised to act for the website, account, or business you ask us to review.
  • Sharing that material with us does not breach anyone else's contract, confidentiality obligation, or intellectual property rights.
  • You have the right to grant any access you grant, including access to third-party platforms such as Google Search Console or Google Analytics.

Please do not send us sensitive personal data — payment card numbers, government identifiers, health records, or similar — through the website forms. They are not built for it. If a project needs that kind of data, we will agree a secure route in writing first.

You keep ownership of what you send. You give us permission to use it for the limited purpose of answering you and preparing the work you asked for. How we store and delete it is set out in our privacy policy.

Section 7

AI-assisted work and human review

Read this one

We build with AI, and AI systems get things wrong. Any audit, report, draft, or agent output we produce can contain errors, out-of-date facts, or confident statements that are simply incorrect. Treat it as work to review, not as a result to act on unchecked.

Every system we design keeps a review point where a person can approve, edit, or reject what the automation produced. That is a deliberate part of our method, not an afterthought. Pricing decisions, sensitive client messages, final approvals, policy exceptions, and brand-sensitive content should always keep a named person in the loop.

You remain responsible for what your business publishes, sends, or decides, even where an automation we built helped produce it. You are also responsible for meeting any rules that apply to your industry, including disclosure rules about automated contact.

Section 8

Acceptable use

While using this site, you agree not to:

  • Break any law, regulation, or third-party right while using the site.
  • Submit another company's website for an audit without authority to act for that company.
  • Scrape, crawl, or harvest the site at a rate that degrades it for anyone else, or bypass our bot protection.
  • Probe, scan, or test the security of the site or our infrastructure without written permission.
  • Upload anything containing malware, or attempt to gain access to accounts, systems, or data that are not yours.
  • Use the site to send spam, chain messages, or unsolicited commercial mail.
  • Copy the site's content or design to pass it off as your own, or resell our materials.
  • Misrepresent who you are, or submit contact details you do not control.

We use automated bot protection on our forms. Legitimate submissions occasionally get caught by it. If that happens, email us directly and we will pick it up.

Section 9

Intellectual property

The site's content, design, code, wordmark, and written material belong to Hypd or our licensors, and are protected by copyright and trademark law. You may read, share links to, and quote short extracts with attribution. You may not copy the site wholesale, reuse its design for a competing offer, or present our material as your own.

Ownership of project deliverables — automations, agents, code, and documents we build for you — is set out in the written agreement for that project, not here. Unless that agreement says otherwise, we keep ownership of the general methods, tools, and reusable components we bring to the work, and you get the right to use what we deliver in your business.

Section 10

Third-party links and services

The site links to other websites and relies on third-party providers for hosting, analytics, email, and form storage. We do not control those parties and are not responsible for their content, terms, or practices. Following an external link is at your own risk, and that site's own terms apply once you arrive.

Disclaimers

Availability

The site and any tools on it are provided as-is. We do not promise uninterrupted or error-free access.

Third-party platforms

Automations depend on services such as Google, CRM vendors, and hosting providers. We do not control their uptime, pricing, or API changes.

Business outcomes

We do not guarantee specific revenue, rankings, lead volume, or hours saved. Results depend on your market, data, and follow-through.

Not professional advice

Nothing on this site is legal, tax, accounting, or compliance advice. Use your own professionals for those decisions.

To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers, in which case the ones they prohibit do not apply to you.

Section 12

Limitation of liability

To the fullest extent permitted by law, Hypd is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from your use of this site — even if we were told such damages were possible.

Our total liability for any claim connected to this website is limited to one hundred US dollars (USD 100), because the website is provided free of charge. Liability for paid project work is governed by the written agreement covering that project, not by this limit.

Nothing here excludes liability that cannot lawfully be excluded, such as liability for fraud or for death or personal injury caused by negligence.

Section 13

Indemnification

You agree to cover Hypd against claims, losses, and reasonable legal costs arising from your misuse of the site, your breach of these terms, or your submission of material you had no right to share with us — including a claim that you gave us access to a system you were not authorised to grant.

Section 14

Suspension and changes

We may suspend or block access to the site, decline a submission, or withdraw the free audit offer at any time, without notice, where we reasonably believe these terms have been broken or the site is being abused.

We may also change, move, or remove parts of the site. We are not obliged to keep any particular page, tool, or offer available.

Section 15

Changes to these terms

When these terms change we update the "Last updated" date at the top of the page. Continuing to use the site after a change means you accept the revised terms. If a change materially affects an active project, the written agreement for that project takes precedence and we will contact you directly.

Section 16

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. The courts located in Bexar County, Texas have exclusive jurisdiction, and both sides consent to that venue.

Before filing anything, please email us and give us 30 days to resolve the problem directly. Most disputes end there, and it is cheaper for everyone.

Section 17

General

  • If any provision is found unenforceable, the rest stays in force and the unenforceable part is limited to the minimum extent necessary.
  • Not enforcing a term once does not waive our right to enforce it later.
  • You may not transfer your rights under these terms without our written consent. We may transfer ours as part of a business sale or reorganisation.
  • These terms, plus our privacy policy, are the entire agreement about your use of this website. Project work is governed by its own signed agreement, which prevails over these terms where the two conflict.
